The Attorney General of the State of Querétaro is requesting a three-year prison sentence for a 14-year-old girl who suffered a spontaneous abortion, in addition to asking for “reparations for damages” of more than half a million pesos for the “father of the fetus,” despite the fact that the pregnancy of the minor was caused by rape.
During the intermediate hearing of the case, the Attorney General of the State requested three years of prison in the Center for Social Reinsertion for Adolescents against the minor, who suffered a spontaneous abortion in the municipality of Huimilpan, in addition to reparations for damages of 518 thousand pesos for whoever is the father of the fetus, according to what Mayra Dávila, president of the Adax Digitales association, which supports and advises the minor, told the local press.
According to what was declared by Dávila herself, the minor became pregnant due to rape, but she did not know of her pregnancy until the abortion occurred; She was treated by emergency services when she suffered severe bleeding, and those who treated her were the ones who notified the authorities, who initiated the investigation file CI/QRO/20351/2023.
“There was no exclusion of the evidence that the Prosecutor’s Office has. That is, we are going to trial with everything that is included in the file, without the exclusion of any of the evidence being admitted. We asked that this testimony be dismissed because it is re-victimizing and because it is not related to the fact that is being investigated,” Dávila told the local press.
The leader of the Adax Digitales association said that the precautionary measure of house arrest that weighs on the girl remains in force, and that in five business days the date of the trial hearing against her will be announced.
In an interview for the Diario de Querétaro website, the state attorney general, Víctor Antonio de Jesús Hernández, confirmed last month that a homicide investigation had been initiated against the girl. Hernández told the outlet that the investigation was initiated because it involved the death of a person who was more than 36 weeks pregnant. In this regard, she pointed out that the state has not prosecuted any investigation file for the crime of abortion
Querétaro continues to penalize abortion
However, according to data from Adax Digitales, the state has initiated seven investigation files for the crime of abortion in the state, despite the fact that by ruling of the Supreme Court of Justice of the Nation (SCJN) these types of cases cannot be judged.
“I saw an interview given by the head of the state prosecutor’s office where he said ‘no investigation files have been prosecuted for the crime of abortion, that is true, what we are pointing out is that investigation files continue to be initiated for the crime of abortion even when they cannot be prosecuted,” Dávila Alvarado pointed out.
