The Third Collegiate Court based in Cancun ruled in favor of Uber, granting it an injunction that allows the platform to operate in Quintana Roo without the need for a concession. This historic ruling establishes that transportation services by application are not considered public transportation in the current legal framework, so they are not subject to the same regulations as traditional services such as taxis.

The magistrates argued that the nature of Uber and similar services does not fit the definition of public transportation, which exempts them from complying with the concession requirements. The decision confirms a legal position held in previous rulings and revokes any attempt to impose restrictions that do not correspond to their operation.

Uber, which has been present in the state since 2016, welcomed the resolution, highlighting that its service provides accessible and reliable options to both locals and tourists in Quintana Roo. For their part, representatives of the taxi union have expressed their discontent, pointing out a competition that they consider unequal.

This verdict sets an important precedent in the regulation of ride-hailing in Mexico and reinforces the operation of these platforms in the country, particularly in tourist states such as Quintana Roo.
