Francisco Pérez Lobato, a real estate businessman and former legal director at Gigante Grupo Inmobiliario, was arrested in Tulum, Quintana Roo, after evading capture for over eight months. He is accused of committing fraud related to the SÚUT luxury complex in Playa del Carmen, a project he left unfinished, resulting in significant financial losses for clients and financial institutions.
Allegations and Misuse of Funds
Pérez Lobato, head of Desarrollos Turísticos LT, allegedly misused a loan of 90.6 million pesos intended for the construction of the development. Additionally, he is suspected of diverting funds from the pre-sale of 91 apartments in the complex, bringing the total fraud amount to over 200 million pesos. The complainants include buyers and the financial institution that granted the loan, represented by attorney Gabriel Castañeda of Nassar Nassar y Asociados.
Investigation Findings
Investigations revealed that both Pérez Lobato and his son, Ian Pérez López, made substantial transfers and deposits during their management of the project. These funds were allegedly used to purchase luxury goods and family properties. The housing complex, which was supposed to be a luxury icon in Playa del Carmen, remains abandoned. None of the 91 apartments have been completed or delivered, and the structures show significant damage from hurricanes, humidity, and general wear and tear.
Construction Company Statement
The construction company responsible for the project, Carsa, stated that it has no responsibility in the case, as it has not had contact with Pérez Lobato for over six months.
Arrest and Legal Proceedings
The arrest of Francisco Pérez Lobato was made possible through the collaboration of authorities in Quintana Roo and Mexico City. He was apprehended on the night of November 26 by ministerial police and transferred to the state prosecutor’s office to face charges. His son, Ian Pérez López, remains at large. Those affected, including clients and the defrauded bank, are demanding the return of their money and justice for the damages caused.
