Being a real estate agent has become a job that anyone can access, even without being professionalized or accredited in the field. This in turn contributes to the commission of fraud or scams when acquiring a property, a problem to which Puebla is no stranger. This has been raised by the local deputy of Morena, Roberto Zatarain Leal, when proposing an initiative to create the State Registry of Real Estate Agents, which will regulate the activity of said workers in the entity.
The initiative to reform the Law of Construction and Real Estate Services for the State and Municipalities, and which was referred to the Urban Development and Housing commissions of Congress for analysis, proposes that said registry be public, so that anyone can see it, and be administered by the Ministry of Economy and Labor.
Most cases occur in areas with higher capital gains
The reform proposes that for a natural person to be registered in the Registry, and therefore, to be able to carry out said activity, he or she must comply with six requirements, which will be the following: official identification with a photograph, accreditation of specialized knowledge in real estate services, acceptance of training and updates (which will be necessary for renewal), proof of address, proof of registration in the Federal Registry of Taxpayers and, in the case of foreigners, proof of immigration status.
In this way, the deputy explained in his proposal, those who work as real estate agents will not only guarantee that they are qualified to carry out their work, but will also be obliged, without exception, to pay taxes and continue to update themselves on the subject in order to remain on the registry every time it is updated.
Also, buyers will have the certainty that, when purchasing a property in Puebla, they do so with a certified agent, thus avoiding falling into fraud or scams with people or agencies that are not registered.
It will suffer a 1.4 percent contraction
It is worth mentioning that real estate agencies, registered as legal entities with the Tax Administration System (SAT) must also comply with this step. Some of their requirements to belong to said registry, if the reform is approved, will be: their articles of incorporation issued by a Notary Public, power of attorney from the legal representative and their current identification, address of branches or offices and the list of individuals who provide their real estate services.
“Puebla is one of the few that does not have a regulation regarding real estate services, which encourages informality in the real estate sector and with it an environment where fraud is more likely to occur. Currently, it is estimated that there are more than 80 thousand real estate agents in the country, according to INEGI, of which only 15 percent are affiliated with some recognized association,” Zatarain concluded.
