They seek to link hotelier to fraud trial in Baja California Sur; victims were kidnapped when demanding payment

A federal judge will decide on January 16 whether to prosecute Cuauhtémoc Édgar Velázquez Fierro for his alleged responsibility in the specific crime of fraud for 24 million pesos in a hotel complex in Baja California Sur.

According to the file, the fraud complaint was filed after the company DGU Baja, of which Velázquez Fierro is a partner, refused to pay for the construction of the Amanvari hotel complex.

DGU Baja is a company formed by the companies DOTTOR GROUP MEXICO, S. DE R.L. DE C.V. and TERRA PLANA, S.A. DE C.V., owned by Cuauhtémoc Édgar Velázquez Fierro, which entered into several contracts with the construction company Mármol y Granito, for the architectural project “Amanvari, located on Calle Eureka, Unidad Privativa Manzana 19, Condominio Maestro Horizontal, Ranchería La Ribera, CP 2357, Los Cabos, Baja California Sur.

According to court records, the case began with DGU Baja’s failure to pay MYG for services in the construction of the Amanvari hotel. When a legal representative of MYG, accompanied by a notary public, demanded payment, they were kidnapped.

The first complaint (LRB/064/2022) was dismissed by Judge Zavala Calderón, raising suspicions of corruption.

For that action, there is already a link to a process involving the company DGU Baja, and two of the partners of Cuauhtémoc Édgar Velázquez Fierro, who are Alessio and Pietro Dottor.

After an appeal within file 208/2024 before Magistrate Paul Razo Brooks reversed the decision of Judge José Humberto Zavala Calderón, who initially dismissed the charges of illegal deprivation of liberty against Alessio and Pietro Dottor, partners of the company DGU Baja, along with Cuauhtémoc Édgar Velázquez Fierro.

The subcontracting company Mármol y Granito (MYG), a victim of fraud, is represented by attorneys Leonardo Julián de la Garza García, Rubén Moya Bocanegra and Juan Carlos Toribio Santos, who successfully appealed the decision of Judge José Humberto Zavala Calderón in the investigation files LRB/064/2022 and LRB/046/2023, for kidnapping and are now awaiting the linkage in the fraud case.

The attorneys filed a second complaint (LRB/046/2023), with evidence including videos of the kidnapping and a notarized statement of facts.

This second complaint, appealed before Judge Paul Razo Brooks (case 208/2024), resulted in the revocation of Judge Zavala Calderón’s decision. The Magistrate ordered the linkage to the process of Alessio and Pietro Dottor for illegal deprivation of liberty.

The decision of Judge Razo Brooks not only holds the accused responsible, but also questions the actions of Judge Zavala Calderón, paving the way for an investigation into possible corruption. Preliminary measures prevent the escape of Alessio and Pietro Dottor, prohibiting them from leaving the country.

The judicial resolution also impacted a commercial trial (case 100/2024) with precautionary measures against DGU Baja, culminating in the freezing of bank accounts (freezing ordered by the First Court of First Instance in the Civil Branch of Cabo San Lucas.
