Illegal dismissal of indigenous lawyer from the Guatemalan Consulate in Oaxaca due to maternity is reported

Through social media, activists denounced the violation of human and labor rights of indigenous lawyer Inelva Miguel, who was fired from the Guatemalan Consulate for maternity leave.

The complaint, which is circulating through a video, states that the lawyer, who recently became a mother, was fired from the Guatemalan Consulate General in Oaxaca, on the instructions of the head, Percy Ralda, who denied her entry to his workplace since January 2.

Inelva, an indigenous lawyer who had been providing services to the Consulate since 2014, was not notified of her dismissal. She showed up one day before the end of her vacation period to renew her contract, but was informed of the consul’s decision to fire her.

Before that, Inelva was a victim of sexual harassment by the diplomat, who, upon being rejected by the lawyer, began to harass her at work.

Articles 166 to 170 of the Federal Labor Law establish that pregnant women will have a six-week break before and six weeks after giving birth, during which they will receive their full salary.

The break will be extended in cases where they cannot work due to pregnancy or childbirth. During the time that this situation lasts, they will have the right to 50% of their salary for a period of no more than 60 days.
