Invasion of property or a home in Mexico is a very common crime, as people often believe that occupying a place under the pretext that it is “uninhabited” cannot have any greater consequences than perhaps a fine. However, the consequences of doing so can be far greater.
The crime is classified as property eviction, and occurs when a person (or group of people) forcibly or illegally appropriates property. It is a property crime that can be committed when someone enters private property without permission or refuses to vacate a property after a rental agreement expires.
This offense is also committed when threats or violence are used to seize a house or apartment, and when documents are falsified to create the impression that they have rights to the property in question. Despite this, cases of squatting by “parachutists” or “squatters” are very common, in part due to the limited options many low-income people have for acquiring their own homes.
This crime, according to Article 395 of the Federal Penal Code, is punishable by fines of fifty to five hundred pesos; it also carries a sentence of three months to five years, depending on the severity of the case. The penalty can increase from six months to one year in prison if the squatting group consisted of more than five people. In cases of violence or threats, the prison sentence can be increased.
In this context, it was revealed today that an elderly woman, identified as Carlota “N,” was arrested for assaulting a group of people who allegedly invaded her property.
According to a statement issued by the Attorney General’s Office of the State of Mexico, two adult men lost their lives after this woman, at least 70 years old, along with two other people, attacked them with firearms.
Journalist Carlos Jiménez stated on his social media account X that this woman is the mother of former PRD local and federal deputy Arturo Santana Alfaro.
“She says they invaded her; they were renting. Ma Carlota Alfaro is 74 years old. She is the mother of former PRD deputy Arturo Santana. She left her house in the Iztapalapa borough and went with her other two children to fire a bullet like that,” the journalist wrote.
