According to the ruling, the initiatives contemplate a prison sentence of two to six years, in addition to 50 to 100 hours of community service in areas related to respect for sexual diversity and inclusion.

According to the reforms, practices consisting of psychological or psychiatric sessions, methods, treatments, or any conduct that aims to nullify, hinder, modify, or undermine a person’s gender identity or sexual orientation constitute a violation of human rights. It is worth noting that the Political Constitution of the United Mexican States recognizes equality and prohibits all discrimination based on sexual orientation or gender identity, as per Articles 1 and 4.

“The existence of these practices is incompatible with a democratic society based on human rights, and therefore the State has the obligation to eradicate them through prohibition and criminalization,” according to the initiative.

The decree stipulates that it will come into effect the day after its publication in the Official Gazette of the Government of the State of Durango and repeals all provisions that oppose its content.
