Mexico City Electoral Court has compelling evidence to annul election in Álvaro Obregón: Lía Limón

The PAN-PRI-PRD candidate claims that she documented the illegal substitution of officials in at least 78 polling stations and that the Morena-PT-PVEM candidate, Javier López Casarín, exceeded the campaign spending limit by more than 3.5 million pesos, among other causes for nullifying the vote.

The PAN-PRI-PRD candidate for the Álvaro Obregón mayor’s office, Lía Limón García, stated that she has already presented conclusive evidence to demonstrate that in the election of June 2, officials were replaced in at least 78 polling stations; violent acts occurred in the vicinity of voting centers; there was improper use of social programs and public servants intervened to induce voting, and that the Morena-PT-PVEM candidate, Javier López Casarín, exceeded the campaign spending limit by more than 3.5 million pesos, all of which are causes for nullifying the vote.

In addition, he reported that “convincing” evidence was submitted to the Electoral Tribunal of Mexico City (TECDMX) that this contender had access to unauthorized media to campaign; he engaged in vote buying and early campaigning, and that he engaged in proselytism during the electoral ban, which undermined the fairness of the election.

As of last Monday, the TECDMX had received four challenges to the election for mayor and councilors in Álvaro Obregón and two to the election of local deputies by the principle of relative majority in districts that correspond to that territorial demarcation.

In an interview, Limón García, who is seeking reelection to the post, reported that the magistrate that is reviewing his complaint has already issued the act of admission, so the matter is in the substantiation stage and the evidence has already been provided to show that he is right.

He said that his campaign team managed to gather the elements to prove that, in at least 78 polling stations, the officials who were trained to fulfill that function were replaced by people who were in those voting centers when they were about to open, but who are not from the electoral sections, which constitutes a violation of the electoral legal framework.

He assured that these are people who are not on the nominal list that corresponds to the polling stations where they were appointed as officials. “This constitutes a serious violation of the process and is cause for nullity.”

According to the Electoral Institute of CDMX, in the election for the Álvaro Obregón mayor’s office, the candidate of Morena and its allies, Javier Joaquín López Casarín, obtained 190,455 votes, equivalent to 47.26%, while the PAN-PRI-PRD candidate gathered 179,853 votes, equivalent to 44.63 percent. That is, the difference between first and second place is 10,602 votes or 2.63 percent.

If, on average, 350 people voted in each of the 78 disputed polling stations, that would be around 27,000 votes in total, so if it were proven that there were irregularities that forced the annulment of the election in those places, it would be decisive in the results of the election.

The candidate said that it was also possible to document various incidents of violence in the vicinity of polling stations and the distribution of the so-called Tarjeta Obregonense, to citizens of various neighborhoods in the municipality, in exchange for the vote. Among the evidence they presented some plastics of the card in question.

Questions work of the IECM

On the other hand, Limón García called attention to the fact that during the entire electoral process she presented around 200 complaints to the Electoral Institute of Mexico City (IECM) for various irregularities in the competition and never received a response.

Among these complaints, the ones that record at least 20 early campaign acts by the Morena candidate and his allies stand out.

In this regard, she stated: “The truth is that the Electoral Institute of Mexico City was absolutely negligent and this omission affected the electoral result in a very important way.”

She stressed that the behavior of this institution must be reviewed, because, practically every Monday during the campaign period, the different PAN-PRI-PRD mayoral candidates expressed their concern about the actions of this institution and were ignored, as they did with complaints filed with the specialized prosecutor’s office for electoral crimes.

The candidate was confident that with the evidence presented, the resolution of the TECDMX will be favorable and if not, she announced that she will appeal to the Regional Chamber or even to the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation.

She emphasized that democracy is not only a system of government, but one of the pillars on which our freedoms and rights are built. In every election, not only are leaders elected, but we also reaffirm and confirm our commitment to the fundamental principles and rules that must be followed, and in this case they were not followed, he added.
