For the crime of fraud in the sale of timeshares in the tourist destination of Los Cabos, in Baja California Sur, six people were brought to trial, after it was proven that they had used 17 million pesos and more than 800 thousand dollars for their benefit.
According to the State Attorney General’s Office (PGJE), after an investigation, arrest warrants were obtained and for the probable crimes of aggravated fraud and specific breach of trust and they were presented before the control judge who determined precautionary measures consisting of periodic signing, prohibition of certain places and communication with various people, including the victims or offended parties.
The agency confirmed today that the initial hearing was held and according to the investigations, the defendants, Antonio “N”, Miriam “N”, Rubén “N”, Fernando “N”, Roberto “N” and José “N”, in their capacity as employees of Commercial Companies, personally made 63 contracts in national and foreign currency for lodging services in the “Timeshare” modality and retained the amounts collected for their own benefit.
Through deception, they entered into contracts with 22 individuals, a total of 27 contracts in US dollars and 33 individuals, with 36 contracts in national currency, causing a patrimonial loss to the Commercial Companies of 17 million 808 thousand pesos and 804 thousand 874 dollars.
After receiving the complaint of these events, the agent of the Public Ministry of the High Impact Subprosecutor’s Office began with the investigations to gather the evidence, which was finally presented for the initial hearing and in view of the above, it was decided to link them to the process.
Tourism authorities in Los Cabos indicated that for months they have been working with authorities to review this issue of fraud in timeshares, both with the Federal Consumer Protection Agency and with authorities from the state Tourism Secretariat, since it impacts the image of the destination and a resolution as soon as possible is a priority.
