Electoral Court in Querétaro revokes Morena’s victory in a deputyship and gives it to the PAN

Weeks after the elections of June 2, 2024, the Electoral Court of the State of Querétaro (TEEQ) issued a resolution regarding an appeal. They decided to remove the victory from Eric Silva, candidate for deputy of Morena, and awarded that place to the PAN member Leticia Rubio, in District 14.

During a Public Resolution Session from the Plenary of the Electoral Court of the State of Querétaro (TEEQ), this Thursday, August 8, 2024, the magistrates resolved the annulment of four polling stations due to irregularities. With this action, they subtracted votes from the candidate of the National Regeneration Movement (Morena), a situation that favored his rival in the elections.

In the argument, Judge Ricardo Gutiérrez Rodríguez explained that, within the file TEEQ-JN-1/2024, they found elements to determine a violation of the electoral process in polling stations located in sections 90, 96, as well as 684. Due to this situation, they considered the annulment of the results of said polling stations to be appropriate.

In this regard, the general secretary of the National Regeneration Movement (Morena) in the state condemned the decision issued by the Electoral Court of the State of Querétaro (TEEQ). On his social networks, he assured that it had as its background the objective of removing the majority from the cherry party and announced that he will seek to go to other instances.

“We regret the resolution of the Electoral Court of Querétaro who has just revoked the victory of our colleague Eric Silva. With this they seek to eliminate the majority of Morena in the local congress. We will defend the popular will of District 14 in the regional chamber,” he wrote on his verified account on the social network X, formerly Twitter, @alexperezsl.

In this sense, the National Regeneration Movement (Morena) in Querétaro will go to the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), in the Regional Chamber of Toluca. In this instance, they will appeal the decision taken regarding the election of Local District XIV with headquarters in the municipality of Ezquiel Montes.

It is worth mentioning that with the resolution issued by the Electoral Tribunal of the State of Querétaro (TEEQ) the distribution in the LXI Legislature of the Chamber of Deputies will also be modified. And it is that, in addition to losing a legislator, the Parliamentary Group of Morena will lose the majority because, by the principle of proportional representation, the National Action Party in the state will gain one more local deputy.

It is worth mentioning that this is not the first time that, after the elections, the result of the elections for the local Congress in District XIV with headquarters in the municipality of Ezequiel Montes is reviewed by the electoral authorities.

Due to alleged irregularities in the result, four days after the election day, the Electoral Institute of the State of Querétaro (IEEQ) carried out the recount of the polling stations in Local District XIV, with which the electoral result changed and, consequently, the certificate of majority was given to the candidate Eric Silva Hernández.

In the recount, according to information from the IEEQ, the candidate of the National Regeneration Movement (Morena) obtained a total of 27,977 votes, while Leticia Rubio Montes, a PAN candidate, but supported by the Democratic Revolutionary Party (PRD) and the Institutional Revolutionary Party (PRI), received the preference of 27,866 people.
