Federal government exposes Jalisco magistrates who returned millions of dollars in assets to the CJNG

Although they covered their faces, the names of the three magistrates who decided to return millions of pesos in real estate to 13 alleged members of the Jalisco Nueva Generación Cartel (CJNG) appeared on the screen installed in the National Palace for the morning press conferences of President Andrés Manuel López Obrador.

The person in charge of revealing the names of the magistrates of the First Collegiate Court in Criminal Matters of the Third District of Jalisco was the Undersecretary of Public Security of the Secretariat of Security and Citizen Protection (SSPC), Luis Rodríguez Bucio, who during the presentation of the report “Zero Impunity” said that the magistrates “favored” the owners of several luxury items that were seized during a search in 2021.

Rodríguez Bucio added that the magistrates granted an injunction to return 13 luxury cars and a property in Zapopan, Jalisco, to the 13 people apparently associated with the CJNG, this after considering that the actions of the Attorney General’s Office (FGR) violate their rights established in article 16 of the Constitution.

In one of the images projected in the Treasury Room, the names of the judges José Clemente Cervantes and Manuel Cano Maynez (votes in favor) and Taide Noel Sánchez Núñez (vote against) appeared, who decided on August 13 to grant the amparo 285/2023.

The seizures, the federal official indicated, were the result of a search warrant derived from the investigation into the kidnapping of two members of the Navy (Semar) that occurred on November 15, 2021. Among the returned vehicles are:

Judge who released CJNG member is in the FGR’s sights

In 2022, Judge Daniel Ramírez Peña served as a control judge assigned to the Federal Criminal Justice Center of Almoloya de Juárez, State of Mexico, a position from which he ordered the release of Aldrin Miguel Jarquín, better known as “El Chaparrito.”

Although he was singled out by Mexican and US authorities for being one of the main plaza bosses of the CJNG in the state of Colima, in addition to being sanctioned by the Office of Foreign Assets Control (OFAC) and the Financial Intelligence Unit (UIF); in June 2022, after 80 days of imprisonment, the judge ordered the criminal to be released on the condition that he attend a hearing. He did not do so.

“El Chaparrito” is identified as one of the men closest to Nemesio “El Mencho” Oseguera Cervantes, leader of the CJNG; however, and against the evidence, the judge stated that there were no elements to proceed against him.

The leader of the CJNG was recaptured last August during an operation by the FGR and the Semar, who identified “El Chaparrito” in the city of Mérida, Yucatán, where he was hiding under the guise of a “successful businessman.”

Regarding the judge who released him, he now holds himself out as a Circuit Magistrate in the Collegiate Court of Appeals of the Thirty-Second Circuit based in Colima; a promotion despite the fact that he was also accused of favoring former magistrate Isidro Avelar Gutiérrez, accused of illicit enrichment and with alleged links to the CJNG.

The FGR wanted to file charges against the former magistrate for irregularities in his assets of up to 12 million pesos acquired through the irregular sale of a property; however, Judge Ramírez Peña dismissed the charges because the alleged action did not occur during his time in office, but in his private life.
