Former mayor of Chiapas sentenced to 110 years in prison for qualified homicide released; returns to his municipality

The former mayor of Pueblo Nuevo Solistahuacán, Enoch Díaz Pérez, leader of the paramilitary group Amigo Revolucionario No. 7, sentenced for the death of five people during the elections of June 5, 2021, to 110 years in prison for the crime of qualified homicide, was released and has returned to his municipality, reported legal sources and sources close to the family.

By winning a direct injunction, Díaz Pérez left the prison known as El Canelo, located in the municipality of Chiapa, where he was imprisoned to serve the 110 years in prison imposed by a judge for the death of Bernardino Sánchez Gómez, Silvia Sánchez Sánchez, Ramiro Díaz Sánchez, Moisés Sánchez Sánchez and Héctor Hernández López, who were traveling in a van where they were transporting the electoral packages that would be used on June 5, 2021, in Pueblo Nuevo Solistahuácan.

Gunmen fired at the truck on the stretch of road between the communities of Avellano Buenavista and La Cumbre, but during the attack, one of the survivors, Elsa Estrada Sánchez, who suffered several wounds to her body, declared to the Public Prosecutor’s Office that she could see that among the armed group were the former mayor of Pueblo Nuevo Solistahuacán, Enoch Díaz Pérez, his brother Samuel and Enoch Díaz Ruiz, son of the alleged paramilitary leader. David, one of the brothers, was imprisoned in the San Cristóbal de las Casas prison, but his other brothers, Samuel and Jordi, were fugitives.

In January 2015, Enoch was arrested by the PRD when he was mayor of Pueblo Nuevo Solistahuacán and held in the El Amate prison, accused of the crimes of kidnapping, torture, criminal association and abuse of authority against three businessmen, including Edgar Fonseca, events that occurred on December 23, 2014. That time, Congress proceeded to strip him of his immunity as mayor.

But in 2008 he had already been arrested, along with his brother David, for the death of three State Police agents by the paramilitary group known as Los Cacheros, which later took the name Los Diablos and which broke into the municipal seat of Pueblo Nuevo on several occasions.

In Pueblo Nuevo they are afraid to talk about Enoch Díaz Pérez, who in the elections of June 2, 2024, promoted his daughter Mirtle Yuriana Díaz Ruiz, as a candidate for the Partido Encuentro Social (PES) for mayor, but also encouraged the candidacies for that institute, in the municipalities of Jitotol and San Andrés Duraznal. During the search for the Morena candidate for the governorship of Chiapas, he supported Senator Sasil de León Villard, in his municipality, through Alejandro Siles, who was the one who visited him in prison, residents who asked not to be identified said.

They assured that the former mayor is also accused of having detained a group of children asking for candy, during the Day of the Dead. He is also accused of having murdered Armando Montejo López, 52 years old, and his son, Celestino Motejo Díaz, in the Aurora Ermita community on December 19, 2014, which led to the exile of 20 members of that family. This double homicide went unpunished.

In 2022, relatives of the five murdered people warned of the possible release of Enoch Díaz Pérez, but it was at the beginning of this year that he left the prison to return to his municipality, where he remains practically hidden and without appearing at public events.

The Chiapas Prosecutor’s Office has not reported whether it will appeal Díaz Pérez’s release, an agency that on September 17, 2023, announced that it had managed to have a sentence of 110 years in prison imposed on him. “In the oral trial, after the prosecution presented its well-founded and motivated closing arguments, the trial judge of San Cristóbal de las Casas issued the final ruling against the accused.” In addition, he was ordered to pay compensation for the damages.

The release of the former mayor was confirmed by members of the Superior Court of Justice of the State of Chiapas and sources close to the family.
