Closure of works due to improper use of land in three subdivisions is demanded

Residents of the Hacienda Agua Caliente, Las Plazas, and Lomas de Agua Caliente sixth section subdivisions demonstrated this Wednesday at the City Hall, to accuse that the use of land in that area is not respected, with constructions that go beyond the norm.

Juan Marcos Gutiérrez, the residents’ lawyer, said that they have systematically raised with local governments, from the administration of Arturo González Cruz to the current one of Ismael Burgueño, the need to respect the use of single-family land declared in the agreements of these three subdivisions.

He explained that in the case of Las Plazas, they want to develop a multi-family home in which there is already a firm injunction, which orders the Urban Administration Directorate (DAU) to close the work.

And simply, he added, they have evaded it with multiple stratagems, especially from the previous administration, where the then director of the DAU corruptly and illegally handed over, violating the amparo laws, a land use that the courts have already referred to them as illegal, and yet they still do not proceed.

Regarding an apartment project on Jazmines Street in the sixth section of Lomas de Agua Caliente subdivision, he pointed out that in this case there are some beams that extend over the public road.

Meanwhile, regarding a so-called Plaza Altezza, he acknowledged that it has a commercial land use of origin, and that the problem is not the commerce, but the density, pointing out that the law clearly limits the possible construction of a shopping plaza in neighborhoods and subdivisions to 300 square meters, and they authorized it with more than double that, with 750 meters.

“Several of us here live right next door, we can no longer turn around safely, there are many crashes,” said the neighbors’ lawyer.

He said that they have court rulings ordering the DAU to close down construction sites or act accordingly, and they simply continue to act in favor of the developers and completely against the interests of the citizens.

The neighbors who came to protest were received by personnel from the Secretariat of Territorial, Urban and Environmental Development (SDTUA) at the Tijuana City Hall, where they carried a banner and signs in protest.
