New criminal complaint filed in the Adamar case in Playa del Carmen

A third criminal complaint for breaking official seals was filed by the Federal Attorney for Environmental Protection (Profepa) against whoever is responsible for the construction of the Adamar Soliman condominium.

According to a court agreement, it is reported that a new criminal complaint was filed at the site, where the illegal construction of a condominium-type building is being carried out.

“I come to file a formal complaint of facts that could constitute the crime of breaking official seals against whoever is responsible (…) for the acts described below and that could be classified as a crime under the Federal Penal Code,” reads the agreement for indirect protection case file 151/2024.

Profepa has placed closure seals on the site, which the real estate developer has refused to comply with, allowing workers to enter to continue construction of the building.

Given this, a criminal complaint was filed with the Attorney General’s Office (FGR), which has jurisdiction to hear these types of cases.

The main driving force behind this litigation is the civil association Defending the Right to a Healthy Environment (Dmas).

According to testimonies collected on-site by the organization, it was indicated that construction continues, although on a smaller scale and in a discreet manner compared to the massive construction that was taking place a few weeks ago.

The subject of the lawsuit is the failure of authorities at all three levels of government to halt the construction of a seven-story building built without permits on the coastal dune. The name is Adamar Solimán, promoted by Desarrollos Tulum Dieciseis, according to the Environmental Impact Statement (EIS) filed with Semarnat (Semarnat).

Construction of this building began in November 2023, when local residents reported the incident to this media outlet. A legal battle ensued, which has yet to be resolved.

About five kilometers north of the area is the Xcacel Xcacelito Sea Turtle Sanctuary, while to the south lies the town of Tulum, surrounded by the protected natural areas of Jaguar National Park and Tulum National Park.
