The Oaxaca State Attorney General’s Office (FGEO), in coordination with the Mexico City Attorney General’s Office, successfully executed an arrest warrant against Roberto “N,” Chairman of the Board of Directors and General Director of Hoteles Misión, and Gerardo “N,” director of Miscorpus S.A. de C.V., for the crime of fraud exceeding 45 million pesos.
The case stems from the failure to pay the lease for the San Felipe Misión Hotel, located in San Felipe del Agua, Oaxaca, owned by investors affected by this irregular financial scheme.
Origin of the dispute: Breach of contract since 2022
According to criminal records, the dispute began in January 2022, when Roberto “N” stopped paying the rent corresponding to the lease signed in 2011.
The accumulated debt amounts to $45,323,247.91, an amount that includes interest and updates through February 2025. The legal agreement established payment for the use of the property at Avenida Jalisco No. 15, one of the most exclusive areas of Oaxaca de Juárez.
Judge orders hotel intervention and discovers new irregularity
Faced with the breach, the hotel owners filed a commercial lawsuit before the Federal Commercial District Court in Oaxaca. As a precautionary measure, the judge ordered:
Retention of assets linked to the hotel.
Appointment of an auditor to manage the establishment’s finances.
During this intervention, it was discovered that Roberto “N,” representing Lusami S.A. de C.V., had signed a new contract without authorization with Miscorpus S.A. de C.V. (a company managed by Gerardo “N”), illegally transferring operation of the Hotel San Felipe Misión.
Joint operation results in arrest in Mexico City
Following the court ruling, the FGEO began an investigation through the Specialized Unit for Combating Kidnapping (UECS). Thanks to a collaboration agreement with the Mexico City Prosecutor’s Office, those involved were located and arrested in the country’s capital.
The detainees were:
Roberto “N”: Top executive of Hoteles Misión.
Gerardo “N”: Manager of Miscorpus S.A. de C.V.
Both were transferred to Oaxaca and placed at the disposal of the Public Prosecutor’s Office, where they will face criminal proceedings for fraud.
