Mexico City. — The Supreme Court of Justice of the Nation (SCJN) has ruled on the mandatory registration of mobile phones with personal and biometric data (PANAUT) and determined that it is unconstitutional, as it violates citizens’ right to privacy and the protection of their personal data.

The Supreme Court’s ruling prevents the State from forcing users to provide biometric data or personal information as a condition for maintaining a phone line. The ruling establishes that there is no constitutional basis for requiring this type of mass registration and that the measure fails the proportionality test, as it affects fundamental rights without guaranteeing an effective reduction in crime.

⚖️ FIRM JUDICIAL CRITERION
In its analysis, the Court concluded that the registry lacked sufficient safeguards, exposed sensitive information, and transferred the risk to the population by concentrating data of high value to criminals. The court maintained that public safety cannot be built at the expense of indiscriminately monitoring citizens.

📜 EFFECTS OF THE RULING
With this decision:
You cannot be forced to provide biometric or personal data to maintain your phone line.
The provisions that conditioned telephone service on registration are nullified.
It is reaffirmed that the protection of personal data is a constitutional right.

The Supreme Court of Justice of the Nation (SCJN) made it clear that combating crime is not achieved by monitoring the entire population, but by strengthening institutions, improving investigative capabilities, and prosecuting those responsible, without criminalizing users.
