The Legislative Branch approved the creation of the Law on Enforced Disappearance of Persons and Disappearance Committed by Individuals in Baja California Sur this Thursday, February 5th. The law seeks to strengthen prevention, immediate search, investigation, and comprehensive support for victims and their families.
The new law aims to protect the human rights of the people of Baja California Sur against actions that affect social peace, the tranquility of individuals, and the family fabric.
“It represents a substantial step forward in establishing a comprehensive and specialized framework that allows for a more agile, effective, and coordinated response to cases of disappearance,” stated the Congress of Baja California Sur.
The Law includes the use of technological tools, strengthened institutional coordination between prosecutors’ offices, and the exchange of and access to databases.
In this regard, it was detailed that the initiative broadens the scope of sanctions, as not only public servants are subject to liability, but also private individuals who, due to the nature of their economic activities, generate or possess databases, records, or information that they are obligated to make accessible.
During the extraordinary session, it was emphasized that the new legislation is harmonized with the General Law on the matter and with international human rights standards, consolidating a psychosocial approach and recognizing the emotional, social, and familial impact.
It contemplates the creation and consolidation of the State Coordination Mechanism for the Search for Missing Persons, the strengthening of the State Search Commission, and the regulation of the Single Identity Platform, a technological tool for consulting and cross-referencing information.
Finally, it proposes the implementation of the Search, Location, and Identification Form, which will allow for a more agile and effective dissemination of information to locate people in Baja California Sur.
