The Government of Mexico has published an amendment to the Regulations for Traffic on Federally Jurisdictional Highways and Bridges in the Official Gazette of the Federation (DOF). This amendment strengthens the powers of the National Guard (GN) regarding surveillance, enforcement, and operational control on federal roadways.
The decree, published on May 25, 2026, in the Official Gazette of the Federation (DOF), introduces modifications that directly impact private motorists, as well as commercial freight and passenger transport operators, throughout the country.
The National Guard Will Take Precedence Over Traffic Signals
One of the most significant changes establishes that instructions issued by the National Guard (GN) will take precedence over traffic lights, road signs, and standard traffic regulations.
This implies the following:
- Orders issued by GN personnel must be obeyed without exception.
- This applies even if such orders contradict existing road signage.
- GN personnel now constitute the ultimate authority on federal highways.
This adjustment redefines the operational hierarchy on roads and bridges under federal jurisdiction.
What New Powers Will the National Guard Possess?
The amendment significantly expands the corporation’s authority, enabling it to now:
- Issue fines directly.
- Inspect vehicle documentation.
- Verify the physical and mechanical condition of vehicles.
- Implement traffic control measures.
- Administer medical and toxicology tests.
- Order the removal of vehicles.
- Impound vehicles at federal depots.
- Produce technical reports regarding traffic accidents.
Furthermore, the decree stipulates that the National Guard (GN) is authorized to penalize any user of federal roadways who fails to comply with these regulations.
Stricter Controls on Alcohol and Drug Use
Another key aspect of the amendment is the intensification of enforcement operations targeting drivers operating under the influence of intoxicating substances.
Effective immediately:
- Drivers may not refuse to submit to alcohol and drug testing.
- Medical examinations may be conducted.
- Refusal to submit to an inspection may result in immediate detention, in accordance with the Official Gazette of the Federation (DOF).
The regulations specify that individuals who resist or refuse to comply with the instructions of the authorities may be placed at the disposal of the Public Prosecutor’s Office. Greater Control over Cargo and Passenger Transport
The National Guard (GN) will also assume a stricter role in overseeing federal road transport.
Key among the new measures are:
Inspection of operational logs
Supervision of mechanical condition
Verification of mandatory documentation
Increased surveillance of cargo vehicles and public transport units
The aim is to bolster highway safety and mitigate risks associated with transportation.
