A federal judge has approved an $11.5 million class-action settlement for more than 600 Mexican engineers and technical professionals who claimed they were recruited under false pretenses to work for Hyundai and Kia in Georgia.
The lawsuit targeted Hyundai Mobis, Kia Georgia, staffing agency SPJ Connect, and recruiting firm Allswell. The workers, who held TN visas, said they were promised technical positions but were instead placed on factory floors in what they described as a “bait-and-switch scheme.”
They also alleged that they were threatened with deportation if they complained or sought other employment.
The defendants have denied wrongdoing.
One plaintiff, Isidro Arellano, said the settlement demonstrates that workers can take action against employers and obtain justice, regardless of where they come from.
The settlement will cover more than 600 TN visa workers.
