Woman who dragged a dog with her truck in Jalisco sentenced to 3 months in prison

The woman who was caught on video dragging a dog with her truck in the municipality of Tlaquepaque, in the state of Jalisco, will initially spend three months in prison for animal abuse, reported the Jalisco authorities.

Thanks to the pressure that the citizens put on the authorities, the woman, identified as Catalina “L” will spend at least 3 months in jail until she is sentenced, in which she could face up to two years in prison for animal abuse.

On social networks, the video circulated in which a group of people blocked the way to the woman’s car on the streets of Plan de Ayala and Batalla de Trinidad, in the Fraccionamiento Revolución, in the municipality of Tlaquepaque; Catalina “L” was dragging the dog, which was tied by the neck with a kind of cable. When questioned why she was dragging the animal like that, the woman argued that she did it because it got into her truck and caused damage “in other houses.”

When they began to call the patrol, the subject asked “call the police to take him away” referring to the dog; “I am not killing him, I am going to take him to the other house” she insisted. Meanwhile, in the footage released on social media, it can be seen that the dog’s paws had blood due to what this woman did to him. “He didn’t stay like that, he’s crawling like that” she insisted.

Catalina “L”, who identified herself as a police officer, was arrested and charged. For its part, the State Prosecutor’s Office reported that the canine she was dragging and which caused second-degree burns and bleeding on all four legs according to the opinion of the veterinarians who treated him, is two years old and is out of danger.

However, the dog will remain under the protection of Animal Health of Tlaquepaque since it is part of the investigation of this crime, and only when the two-month period of complementary investigation dictated by the judge is concluded, will it be able to begin the adoption process.

The Penal Code for the State of Jalisco classifies as a crime anyone who commits acts of animal abuse and cruelty towards any animal, whether domestic or wild, causing injuries to death.

According to Article 305, a fine equivalent to 20 to 50 times the daily value of the Unit of Measurement and Update (UMA), that is, two thousand 171 to five thousand 428.5 pesos, will be imposed on anyone who causes injuries to an animal, as long as its physical functions or life are not put at risk.

In the event that the physical functions or life of an animal are put at risk, the penalty will be 100 to 300 times the daily value of the UMA, that is, from 10 thousand 857 to 32 thousand 571 pesos. For those who repeat these cases, a sentence of six months to two years in prison and a fine equivalent to 100 to 300 times the daily value of the UMA will be imposed.

Furthermore, Article 306 establishes that whoever causes the death of an animal will receive from six months to three years in prison and a fine of 200,000 to 1,000 times the daily value of the UMA, that is, 21,714 to 108,570 pesos. The penalty could be extended by half when torture is involved.
