The Chamber of Deputies approved the reform to the National Property Law and the Law of Ecological Balance and Environmental Protection, which establishes free, permanent, and open access to Mexico’s beaches.
The amendment, sponsored by Ricardo Monreal, was approved this Wednesday, October 1, with 470 votes in favor and one against from the Citizen Movement.
The reform establishes that access to maritime beaches and the adjacent federal maritime-terrestrial zone must be free, free of charge, permanent, and without distinction based on origin, nationality, or social status.
It also states that federal, state, and municipal authorities shall guarantee, within their jurisdiction, access from public roads, which must be safe, signposted, and provide basic services.
It also adds that the imposition of fees, quotas, or restrictive conditions for access to maritime beaches and the adjacent federal maritime-terrestrial zone is prohibited, except by express provision for environmental prevention and protection, public safety, or national interest.
Furthermore, it states that concessions must include public access to beaches and requires the Ministry of the Environment to provide free access to the protected natural areas under its jurisdiction at least one day a week.
In addition, municipalities and, where applicable, states, must register beach access points in the cadastres and Public Property and Commercial Registries to ensure their permanence and ensure their existence is known in the event of purchase and sale requests.
