It’s the law, and few know it: Querétaro will fine drivers who run out of gas in the middle of the street

Running out of gas in the middle of the street isn’t just an inconvenience: in Querétaro, it can also cost you a fine. The Municipal Traffic and Mobility Regulations state that drivers of motor vehicles must carry “sufficient fuel and lubricant for their proper functioning.”

Although this regulation may be unknown to some, it is in effect and can result in fines for drivers who violate it.

How much can the fine for running out of gas cost you in Querétaro?

Article 76, section II, subsection b of the Traffic and Mobility Regulations establishes financial penalties for those who fail to carry gasoline in their vehicles. Specifically, the fine is between 5 and 10 times the UMA (Unit of Measurement and Update), which is equivalent to between $586.55 and $1,173.10 pesos in 2026. However, this infraction does not result in penalty points on your driver’s license.

The same obligation applies to lubricant in Querétaro: the regulations require that both fuel and lubricant be in sufficient condition before driving.

What exactly does Querétaro’s traffic law say about fuel?

Although few people know it, Article 76 of the municipal regulations establishes that drivers must ensure their vehicle has all the necessary components to operate safely. Fuel and lubricant are explicit requirements for motor vehicles.

In other words, driving with a nearly empty tank and breaking down has legal consequences in Querétaro.
