MASTER GUIDE TO CITIZEN SELF-DEFENSE AND LEGAL RIGHTS (2026 REFORM EDITION)

I. IMMEDIATE SAFETY MEASURES DURING A TRAFFIC STOP

  1. Lock all doors immediately.
  2. Keep the window halfway up: lower it only about 5 centimeters (enough to speak and pass documents). This helps prevent anyone from reaching inside to unlock the vehicle or take your keys.
  3. Keep your phone visible: start recording audio and video before the officer reaches your door.

II. STREET RESPONSE SCRIPT (SPOKEN OUT LOUD)

Initial Contact

“Good afternoon, officer. I am recording this interaction in audio and video for the safety of both parties, pursuant to Article 6 of the Constitution. Please state your name, rank, and badge or file number, and explain the legal reason for stopping my vehicle.”

If the officer says, “Turn off your phone / Recording is prohibited”

“I will not turn it off. Under Article 6 of the Constitution, I have the right to document your actions because you are a public official performing duties in a public space. Your actions are public in nature and are not confidential. Please continue with your procedure.”

If the officer orders you to exit the vehicle

“I am not going to exit the vehicle, officer. Article 203, Section I, of the current regulations expressly states that drivers and passengers should remain inside the vehicle for safety reasons. The law does not require me to exit for a routine traffic violation. I will cooperate with the inspection and receive any citation from my seat while providing my documents through the window.”

If the officer threatens arrest for “disobedience”

“Officer, I am not committing disobedience. I am providing my driver’s license and registration through the window for inspection and will cooperate with the procedure from my seat. Recording this interaction is my constitutional right and does not constitute an offense.”

If the officer threatens towing, impoundment, or commits a serious abuse

“Proceed if the law justifies it, but my vehicle cannot be impounded simply because I am exercising my rights or recording. Everything you are doing is being documented, and this video will be submitted as a complaint to Internal Affairs and as evidence in any legal complaint for abuse of authority.”

If you are subjected to a sobriety checkpoint

“I will fully cooperate with the test from my seat, but I request that you show me the device reading zero and open a new, sealed mouthpiece in front of me and my camera before I provide a sample.”

III. ADAPTATION FOR FEDERAL COMMERCIAL TRANSPORTATION

If you operate a commercial cargo or passenger vehicle under federal jurisdiction, the National Guard has additional inspection authority, and you have specific rights.

Hours-of-Service Logbook

You must carry it in printed or electronic form. Failure to do so may result in a fine but not vehicle impoundment.

Mechanical and Brake Inspections

The National Guard and transportation authorities may inspect braking systems and vehicle conditions. Drivers are required to allow visual technical inspections.

Cargo Transfer During Vehicle Removal

If a truck must be impounded, federal regulations require that the cargo remain available to the owner and that reasonable accommodations be provided for immediate transfer to another vehicle.

IV. WHEN CAN A VEHICLE LEGALLY BE IMPOUNDED?

According to the regulations cited, a vehicle may be impounded only under specific circumstances:

  1. No valid liability insurance.
  2. Driving under the influence of alcohol or drugs following a certified test.
  3. Complete absence of license plates and registration documents, unless covered by a valid theft report or temporary permit.
  4. Critical excess weight or oversized dimensions creating a safety hazard.
  5. Abandonment due to mechanical failure, such as remaining disabled on the roadside for more than 24 consecutive hours.

If you believe a citation was issued improperly, you may have legal options:

Administrative Review

A written appeal may be filed with the relevant authority within the deadlines established by law.

Administrative Court Challenge

You may seek annulment of the citation before the appropriate administrative court.

Suspension of Collection

VI. REPORTING NUMBERS

National Guard

Local Police / Traffic Authorities

Contact the appropriate local public safety agency or emergency services and request a supervisor if necessary.

COMMON VEHICLE DEFECTS AND IMPOUNDMENT

Minor Mechanical Problems

Examples include a burned-out headlight, missing windshield wipers, or a loose exhaust system.

General rule: These issues normally result in a citation rather than vehicle impoundment.

Worn Tires

Driving with worn tires or without a spare tire generally results in a fine.

Possible exception: If the tire is completely destroyed or detached and continuing to drive would create an immediate danger.

Broken Windows or Cracked Windshields

A cracked windshield or broken side window is generally not, by itself, grounds for impoundment. At most, it may result in a citation if it significantly affects visibility.

Suggested Response if Threatened With Towing

“Officer, the regulations provide that minor physical or mechanical defects generally result in a citation or warning. My vehicle does not obstruct traffic and has not been abandoned. Please issue the corresponding citation if you believe a violation exists, and I will address it through the appropriate legal process.
