This action is classified as an obligation under the brand’s club regulations. What the Federal Consumer Protection Law says about checking purchase receipts when leaving supermarkets

Article 10 of the Federal Consumer Protection Law states that any provider of goods or services is prohibited from carrying out actions that threaten the freedom, security, or personal integrity of consumers under the pretext of registration or investigation.

It also establishes that anyone who violates this provision may be subject to an economic penalty, as well as being required to repair moral damages and provide compensation for damages caused.

“ARTICLE 10.- Providers of goods or services are prohibited from carrying out actions that threaten the freedom, security, or personal integrity of consumers under the pretext of registration or investigation. If someone is caught committing a crime in flagrante delicto, providers, their agents, or employees shall, under their responsibility, immediately place the alleged offender at the disposal of the competent authorities.”

The law further establishes that violations of this provision shall be sanctioned in accordance with the law, regardless of the obligation to repair moral damages and compensate for damages caused if the alleged offense cannot be proven.

The law also states that providers may not apply coercive or unfair commercial methods or practices, nor abusive or imposed clauses or conditions when supplying products or services. Likewise, they may not provide additional services that were not expressly requested or accepted by the consumer, whether in writing or electronically, nor may they impose charges without the consumer’s prior consent or without a corresponding contractual basis.

It is important to note that, despite the provisions of the Federal Consumer Protection Law, Costco Mexico continues to check members’ purchase receipts. By purchasing a membership, members agree to comply with the measure established in the company’s regulations.
