If the average of each day exceeds 2,500 over a week, requests will be restricted for people looking to enter the United States

The president of the United States, Joe Biden, signed on Tuesday an executive order that will drastically restrict asylum requests at the border with Mexico, in what is one of its toughest immigration measures and that arrives in full campaign for the elections November generals.

This order will allow US authorities to deport those who do not exceed strict asylum standards when the figure of 2,500 daily arrests at the border is exceeded for an average of seven days, they detailed the press of high US officials.

The Order will enter into force on Tuesday because that figure of 2,500 arrests with an average of 4,200 daily arrests occurred in April, the last official figure available.

The protocols to request asylum will relax once that figure decreases to 1,500 on average for 14 days, which could be difficult to reach since the last time the average arrest fell to 1,500 was in July 2020, in full pandemic.

As detailed by the officials, who reach the border once that 2,500 threshold will be exceeded will be subject to “a significantly higher standard” to qualify for asylum.
Specifically, in that instance, migrants must demonstrate that there is a “reasonable possibility” that they are at risk of torture or be persecuted if they are returned to their country of origin.

In any case, officials argued that the United States will adhere to the obligations of the United Nations Convention against torture, which prohibits expelling someone to a country where it can be tortured.

However, if migrants are not able to demonstrate that they qualify for asylum under this highest standard, they will be deported in a matter of “hours” or “days”, the officials indicated.

In that case, the situation will vary depending on the nationality of the migrant or asylum seeker.

Those who are Mexican or national of Cuba, Haiti, Nicaragua and Venezuela, will be returned directly to Mexico by virtue of previous agreements of Washington with the Mexican authorities.

On the other hand, those who reach the border from other other parts both inside and outside the American continent, such as Colombia or Ecuador, will be expelled in deportation flights.

The standard contemplates exceptions: unaccompanied minors traveling north are not subject to restrictions, as are the victims of traffic of people, those who face acute medical emergency or an extreme threat to their life and security.

In addition, asylum cases of people who have requested an appointment through the “CBP One” mobile application will continue, which offers approximately 1,450 daily appointments to ask for asylum.

The president will make statements about the order, his most aggressive unilateral measure so far after seeing frustrated attempts to reach a bipartisan agreement in Congress, in an event at the White House at 2:00 p.m. local time (18.00 GMT), accompanied by Several mayors of the border.

This order reaches six months from the elections, in which Biden aspires to be re -elected for a second mandate and will face the former president of the United States, Donald Trump again, whose campaign has already criticized the measure by qualifying it as “amnesty”
