
The Attorney General’s Office (FGR) is investigating Joaquín Guzmán López and others for treason for having handed Ismael El Mayo Zambada over to the US.
Yesterday, the FGR stated that immediately after the capture of El Mayo and Joaquín Guzmán López, on July 26, it opened the investigation file SON/HSO/0001/882/2024, for the crimes of illicit flight, illicit use of air facilities, violation of immigration and customs legislation, kidnapping, treason and whatever else may result.
Article 123 of the Federal Penal Code establishes that treason is committed by anyone who, among other assumptions, “illegally deprives a person of his or her freedom in the national territory to hand him or her over to authorities of another country or transfer him or her out of Mexico for that purpose.”
On August 10, attorney Frank Pérez released a letter in which his client, El Mayo Zambada, said he was kidnapped in Mexico by the son of El Chapo Guzmán, who took him against his will to the US.
In the letter he added that in the same place where he was subdued by Guzmán López’s people, Héctor Cuén Ojeda, former federal deputy, former mayor of Culiacán and former rector of the Autonomous University of Sinaloa, was murdered.
“I was aware of an ongoing dispute between Rubén Rocha Moya, governor of Sinaloa, and Héctor Melesio Cuén Ojeda,” El Mayo said, according to the letter released by his attorney.
The letter was released one day after the US ambassador, Ken Salazar, said that El Mayo Zambada was taken against his will to US territory by Joaquín Guzmán López, who agreed to his surrender.
This Sunday, in a statement, the FGR stressed that it has already requested information about the case from the governor of Sinaloa.
It also asked the Sinaloa Prosecutor’s Office to leave the investigation it opened into the murder of Héctor Cuén in federal hands, which may probably be related to the capture of the leader of the Sinaloa cartel.
It also revealed that agents of the Public Ministry, experts and agents of the Ministerial Police, with authorization from the United States government, carried out police and expert proceedings at the Santa Teresa airport, New Mexico, which have already been incorporated into the corresponding file.
“Based on official statements from the US diplomatic representation in Mexico, as well as documents that Ismael ‘N’s lawyer allegedly released to the media in both countries, specific proceedings have been carried out in the area known as Huertos del Pedregal de Culiacán and in the airfield that was possibly used in this case, as well as on all the runways that may be specifically linked to these presumptions.
“In addition, all requests for documentation and information on air navigation have been processed; as well as immigration information between Mexico and the US in this regard; which is being immediately incorporated into the corresponding file.”
He added that the elements that allow requesting the corresponding arrest warrants from the judicial authorities are being integrated and the international affairs area of the FGR is preparing the requests for international legal assistance that are necessary in this case.
He made it clear that the information that may be public will be made known immediately; and when there is any obstacle or delaying tactic in the investigation, it will be investigated further; and if the case allows it, it will be communicated publicly, specifically and without any delay.
Meanwhile, the former presidential candidate of the Fuerza y Corazón por México coalition, Xóchitl Gálvez, considered that the FGR should investigate El Mayo’s allegations about a meeting he would have with the governor of Sinaloa, Rubén Rocha.
Interviewed, the PAN member stated that the federal government supported the Sinaloa governor only because he is from Morena: “I have just been fined for calling Morena a narco-party, but the truth is that it is a direct involvement of El Mayo, of the governor of Sinaloa that the Attorney General’s Office should investigate. I ask: what would have happened if the governor involved had been from the opposition? The President would have issued an arrest warrant, but since he is from Morena, he came out to support him.”
