For self-defense, the PAN (National Action Party) in the Mexico City Congress proposed that women be allowed to use pepper spray and electronic weapons (Tasers). PAN representative Daniela Álvarez Camacho presented this initiative, which seeks to amend the Penal Code and the Law on Women’s Access to a Life Free of Violence.

She said the use of these devices should be permitted due to the high rates of violence against women. In general, she proposes that women be able to use, when they feel in danger, objects such as sprayers, dusters, gasifiers, and chemical dispensers that do not exceed 150 grams and produce temporary effects on the human body without causing unconsciousness.

“Likewise, electronic weapons that only produce temporary effects on the human body are not considered prohibited objects or instruments, provided their use is in legitimate defense of property, assets, or physical integrity, and their use does not cause unconsciousness or endanger life,” the document states.

It added that in the last 12 months in Mexico City, according to the National Survey on the Dynamics of Household Relationships, 68 percent of women aged 15 and over who experienced community violence reported that the primary aggressor was a stranger.

It exemplifies that in Spain, the possession and use of pepper spray is regulated by the Citizen Security Law. It also noted that the Puebla Congress unanimously approved a reform to the Penal Code to legalize the use of pepper spray and electronic immobilizers as self-defense instruments.

“How many women would have liked to have an instrument with which to defend themselves? Creating legal mechanisms to strengthen government actions aimed at protecting women is an obligation that must be fulfilled,” she stated.

The Secretariat of Citizen Security will establish, within 90 days, guidelines on the sale and regulation of pepper spray and electronic weapons. This proposal was referred to the Administration and Law Enforcement Committee and the Gender Equality Committee.
