On July 22, feminist groups announced that the Second Collegiate Court of the Twenty-Fifth Circuit ordered the Durango Congress to decriminalize abortion from the Penal Code.
Days later, the coordinator of the PAN parliamentary group in Congress, Alejandro Mojica, stated that no court could order Congress to decriminalize abortion in general, and that if it were to happen, it would only be in a specific case involving a complainant.
Julieta Hernández Camargo, feminist leader of the civil association Sí Hay Mujeres en Durango, spoke with POSTA, assuring them that abortion will be legal in Durango, despite statements by Representative Alejandro Mojica, who stated that a court could not force Congress to decriminalize it.
The activist stated that she was aware of the ruling, in which her group explains that the State Congress is ordered to decriminalize Articles 148, 148, and 150 of the Penal Code, which penalize abortion in the state of Durango.
This ruling also eliminates the penalty for doctors, nurses, and other members of the health sector who participate in abortions in Durango.
This ruling would be collective, meaning that abortion in Durango will be a right for any woman who wishes to undergo this procedure.
Durango will become the 10th state required to decriminalize abortion.
If the decriminalization of abortion in Durango is confirmed, the state would become the 10th entity required by a court to eliminate the criminalization of this practice from its Penal Code.
In addition, it would be the 25th state in all of Mexico to allow legal abortion, making it a right for women who, for one reason or another, decide to have this practice.
It’s disgraceful that another branch of government forces Congress to decriminalize abortion in Durango.
The activist pointed out that it’s disgraceful that another branch of government in the Durango State Congress has to intervene to grant this right to women.
She also described as shameful that abortion has not yet been decriminalized in Durango, even though the Supreme Court ruled in 2021 that women cannot be criminalized for having an abortion.
