FGR prosecutor in Veracruz accused of abuse of authority and crimes against the administration of justice.

Mauricio Alexandro Rosales García, head prosecutor of the Attorney General’s Office (FGR) in the state of Veracruz, along with prosecutors Carlos Manuel Pérez Solís and Andrea Jahel González Castillo, were reported to the Internal Control Body and the Specialized Internal Affairs Prosecutor’s Office for alleged abuse of authority and offenses against the administration of justice. The complaint alleges that they prevented the release of the “Helipuerto Ing. David Torres,” located in the municipality of Medellín de Bravo, Veracruz, as well as seven aircraft belonging to fumigation company Agrogema Agro, S.A. de C.V.

In January of this year, the Attorney General’s Office (FGR) seized a heliport and six helicopters and one airplane owned by Agrogema Agro, S.A. de C.V., a company dedicated to fumigating sugar mills in Veracruz, over alleged illicit operations. To date, the company has been prevented from accessing the investigation file.

The company’s legal representative, Omar Pérez Gómez, explained that the heliport has been operating since March 2021 and has permits from aviation authorities for aerial agricultural fumigation. It is located near Veracruz International Airport and the Mexican Navy naval base at the port of Veracruz, making it unlikely, he argued, that naval and aviation authorities were unaware of the alleged illicit operations.

“It seems illogical to me that the prosecutorial personnel would make such a statement. It cannot be possible, I mean, with both the Navy and the aviation authorities there, that they would not know about the operations. And especially being so close to them, it is not possible for an aircraft to leave a facility without there always being a record,” said the aerospace engineer.

The company’s legal representative, Jorge Reyes Peralta, alleged that the FGR has not informed the company of its legal status in the investigation, whether it is considered a defendant, victim, or injured party. Despite the constitutional injunctions filed, he has also been denied access to the investigation file justifying the seizure of the property and aircraft.

The company estimates that it has suffered losses of more than 40 million pesos as a result of the eight-month seizure of the aircraft. It is therefore demanding that the matter be investigated to the fullest extent, which could result in the official’s dismissal as well as the corresponding administrative sanctions.

“We are going to seek compensation for moral and material damages resulting from the civil liability of the prosecutor’s office and its officials. Officials of the Attorney General’s Office have insurance that covers civil liability for actions such as this, which, in this case, are being carried out with complete intent and, obviously, with complete impunity,” the attorney said.

An alleged anonymous complaint triggered the investigation at the facility, where crimes were supposedly being committed. This led to drone flights during which armed individuals were allegedly observed, although the prosecutor’s office has not disclosed the recordings.

In videos obtained by Latinus, security personnel can be seen arriving and attempting to prevent security cameras from recording the operation.

“How could they have been carrying out flights or criminal activities next to the heliport and next to the Navy? Are they accomplices? Yes. So, obviously, it is absurd,” Reyes Peralta said.

The company’s attorney, Jorge Reyes Peralta, alleged that after announcing that he would file a complaint with the FGR on Tuesday afternoon, August 17, federal prosecutor Mauricio Alexandro Rosales García brought the investigation before a judge and summoned David Reyes Quintana, owner of Agrogema Agro, to appear before a federal control judge on November 4 at the federal courts in Emiliano Zapata, Veracruz.

“We are asking the Attorney General, Dr. Ernestina Godoy, today, for reasons of public morality, that this federal prosecutor, Rosaldo, should request a leave of absence while the investigation is underway. I want to point out that this federal prosecutor, Rosaldo, was appointed by Alejandro Gertz Manero and is one of the legacies left to Dr. Ernestina Godoy,” the attorney stated.

The legal representative added that, after learning that a complaint would be filed against him, the federal prosecutor in Veracruz brought the case before a judge at the last minute. “So there is no crime that was committed, and the federal prosecutor pulled this judicial proceeding out of thin air yesterday at 6:30 in the evening, knowing that we were coming today to file the complaint and speak with you,” the legal representative alleged.
