Quick guide to passenger rights under the Civil Aviation Act

The Federal Consumer Protection Agency (Profeco) reiterated to travelers the importance of knowing their rights when facing delays, cancellations, or overbooking on commercial flights in Mexico, based on the Civil Aviation Law and the Federal Consumer Protection Law.
According to Article 47 bis of the aeronautical legislation, passengers affected by delays attributable to airlines—such as technical failures, operational problems, or overbooking—are entitled to different compensations depending on the length of the delay.
The benefits include:

  • Between 1 and 2 hours of delay: food and non-alcoholic beverages or discounts on future flights.
  • Between 2 and 4 hours: food, beverages, communication (calls or emails), and partial compensation.
  • More than 4 hours or cancellation: full refund, free rebooking, and a minimum compensation equivalent to 25% of the value of the unused ticket. In cases of overbooking, passengers can request rebooking on the next available flight at no additional cost and receive additional compensation. Profeco recommended that consumers arrive early, keep their check-in receipts and travel documents, and, if they do not receive adequate service from the airline, go to the Profeco service desk at airports or file a formal complaint through its official channels. The authority also reminded airlines that they must clearly publish their compensation policies, available both at check-in counters and online, so that passengers are better informed before traveling.
