An unusual case was reported in Saltillo, Coahuila, where a woman was formally charged with vicarious violence, specifically for allegedly using her children to cause emotional harm to her partner.
The woman, identified as Estela Guadalupe “N”, faced legal proceedings before a judge who determined there was sufficient evidence to proceed with the case. The judge found indications of harm to the children’s father through manipulation of the children.
⚖️ What does being formally charged mean?
It means the judge determined there is sufficient evidence for the case to continue with a formal investigation and proceed to trial. 👩⚖️ Provisional Measures Ordered by the Judge
As part of the process, the judge ordered that the woman:
🔹 Cannot approach the victims
🔹 Cannot approach her children
🔹 Cannot approach her husband
Furthermore, it was established that the minors will remain under the care of their maternal grandmother temporarily, until custody is legally determined, either in favor of the father or as the authorities decide as the case progresses.
👨👩👧 What is Vicarious Violence?
It is a form of domestic violence in which a person:
🔹 Uses the children to harm their partner or ex-partner
🔹 Prevents visitation
🔹 Emotionally manipulates the minors
🔹 Creates conflict between the children and one of the parents
The harm is not direct, but rather indirect, occurring through the children.
📌 This case has drawn attention because, although this crime was primarily established to protect female victims, local legislation allowed a man to file the complaint, with the law being applied according to the reported facts.
Sentences for this crime, if the facts are proven during the legal process, can reach up to six years in prison, in addition to protective measures for minors.
The issue is already generating debate about the extent of vicarious violence in Mexico.
