The increase in cases of invasion and dispossession of private properties in Tijuana and other regions of the country has raised alarms within the real estate sector, as it represents a financial and legal risk for owners and investors.
This warning came from Lersa Mercadillo, a real estate consultant and former president of AMPI Tijuana, who pointed out that this problem not only affects vacant properties but also rental properties where tenants stop paying rent and refuse to vacate.
“This is a real problem that directly impacts owners, who can temporarily lose possession of their properties, generating financial losses and emotional distress,” she stated.
The specialist explained that the legal processes to recover a property can extend for more than a year, and even for several years, considering both the initial lawsuit and the enforcement phase to achieve the eviction.
In this regard, she emphasized the need to promote more agile legal mechanisms and expedited trials that allow for the faster resolution of these types of conflicts, in order to provide greater protection to property owners.
“Today more than ever, legal prevention remains the best tool, since it is not enough to simply review a current contract; it is essential to analyze the origin of the property, its registration history, and its entire legal traceability,” she stated.
Lersa Mercadillo emphasized that, despite this context, Tijuana continues to be an attractive location for real estate investment due to its economic dynamism and urban growth. Therefore, the key lies in conducting transactions with greater care and professional guidance.
